Words of Veterans provides U.S. Veteran users (“you”) access to an AI-assisted writing platform that allows U.S. Veterans to safely process and share their experiences (the “services”). Users may create blog posts, purchase print-on-demand books and other products (the “products”) and/or make donations.

Acceptance of the Terms of Use

These Terms of Use (“Terms”) are between you and Alex Sebby LLC doing business as Words of Veterans (“Company,” “we”, “us”, or “our”). The Terms, together with other agreements made by you, form the binding agreement controlling access to www.wordsofverterans.com, www.alexsebby.com and other affiliated websites under the control of Words of Veterans (each a “website”) and use of the platform, services and products on the websites.

Please read these Terms before you start to use the platform or services. By using the websites or platform or registering for or utilizing a voucher for our services, clicking “I AGREE” or otherwise showing your intent to agree, you indicate you have read and agree to be bound by these Terms and our Privacy Policy, found here. If you do not agree to follow these Terms and our Privacy Policy, you must leave our websites and should not access the platform or services.

Your Responsibilities

By accessing the platform, you make the following representations and commitments:

1. You are (i) 18 years or older and (i) a member or former member of the U.S. military.
2. You will not provide any controlled or classified data in your writing.
3. You are responsible for the accuracy account information provided to us, including your email address, email addresses of others and your shipping address.
4. You will maintain the security of your account and any password and are liable for any activity using your account, whether or not authorized by you.
5. You created, own or have obtained the right to use content (data, responses, photos, graphics, etc.) you provide to us and represent that its use will not violate any laws, rules and regulations or the rights of any person or entity.
6. You are responsible careful review of the blog postings, books or materials produced on the platform or using our services.
7. You will pay, or provide a voucher, for the fees and applicable taxes for all books or products ordered through the website.
8. If you click “I agree” or provide approval to use ChatGPT to assist with writing your story, you will provide payment to us for ChatGPT tokens.
9. You are responsible for your user-generated content (UGC) as described in these Terms.
10. You will reimburse us for any damages and expenses (including interest, attorneys’ fees and costs) we incur or which are asserted against us by a third party as a result of your breach of these Terms or the Privacy Policy, including in connection with your UGC.

If you do not comply with these requirements, we may terminate your access to the websites, platform and/or your use of services.

Links to Third-Party Sites and Services

Words of Veterans’ websites and platforms may link to websites and/or services operated by third parties. We have no control over and assume no responsibility for the content, accuracy, terms and conditions, privacy policies, or practices of any third-party website or service that you interact with through our websites and platform. Before you use any website, you should review the applicable terms of use and policies and evaluate the risks of your use. Third-party services may include:
ChatGPT API (Applicable Programming Interface), Stripe and PayPal.

ChatGPT

Words of Veterans offers you the option to use ChatGPT’s API to assist with writing your story. If you elect to use ChatGPT, you will be asked to provide payment to us for ChatGPT tokens. These tokens are like fees for processing your requests and allow access to the ChatGPT API. Your use of ChatGPT may be through an account maintained by Words of Veterans, so you will provide payment to Words of Veterans to purchase any ChatGPT tokens for this use.

Pricing

You can use the platform to answer the questions and create your story for free. You will then be able to email your story or download the PDF.

If you elect to use ChatGPT to assist in writing your story, you will be asked to pay for a ChatGPT token. If you choose to have your story printed as a book or purchase another product, there will be a fee. All prices are shown on our website and may change on the website without additional notice to you. In rare instances, prices on the website may be inaccurate. We will correct any errors and provide you with accurate information as soon as possible. We are not obligated to honor inaccurate prices. If you fail to make payment as agreed, we may terminate your product order.

Cancellation

In the event you cancel your order after we have started production of your customized Book, but before the page proofs have been provided to you for your review, you will pay [one-half of the order price].

Payment and Donation Processing

Stripe and PayPal, third-party payment platforms, securely handle payment transactions on our behalf. We do not use, observe or store your credit card or bank details. Stripe and PayPal will each have their own Terms of Use and privacy policy.

User Generated Content

User Generated Content (“UGC”) refers to all data, photos, graphics or materials users provide to us, including content created by users with the assistance of our platform or posted to the social-media sites of Words of Veterans. You are responsible for the UGC that you create and post, and may be held personally liable for comments that are defamatory, obscene, or libelous, or that violate these Terms, a confidentiality obligation, or otherwise may violate another party’s intellectual property rights, privacy, publicity, or other rights. Specifically, you agree not to upload, post, transmit, or otherwise make available any UCG that is:

• unlawful conduct encourages illegal activity
• harmful, hateful, abusive, harassing, or racially disparaging
• libelous, defamatory, obscene, pornographic, or indecent
• false, misleading, or fraudulent
• promotes goods or services for personal or financial gain
• promotes a political party, candidate, or issue
• not to be disclosed under any law or any contractual or fiduciary relationship
• violates or infringes upon the rights of others
• or contains a software virus or any other computer code designed to interrupt, destroy, or limit the functionality of any computer software or hardware

You agree to indemnify and hold Words of Veterans harmless from any loss, damage, or expense (including attorney fees) that Words of Veterans incurs in connection with a third-party claim in relation to your UGC.

Your approval will be requested before posting any UGC.
Approval for posting will mean that the UGC is not confidential. By agreeing to post any UGC, you grant Words of Veterans and its licensees, successors, and assigns, you grant Words of Veterans the right to use, reproduce, modify, distribute, copy, and otherwise disclose to third parties any such material.

Because Words of Veterans does not control the UGC posted on or through the websites, Words of Veterans does not warrant or guarantee the truthfulness, integrity, suitability, or quality of that UGC. Words of Veterans is not responsible for any loss or damage of any kind you may claim was incurred as a result of the use of any UGC posted on the websites.

Words of Veterans may remove UGC in its discretion, but it is not obligated to do so. Words of Veterans has the right (but not the obligation) to:

• Monitor all UGC.
• Remove or block any UGC at any time without notice in our discretion.
• Disclose any UGC, and the identity of the user who posted it, in response to a subpoena, court order, or whenever we believe that such disclosure is required by the law, to prevent or investigate a possible injury or crime, to protect the rights of Words of Veterans or others, or to enforce these Terms.
• Terminate your access to the websites, or edit, modify, or block your postings.

Copyright and Takedown Requests

Words of Veterans prohibits users from uploading or posting to or distributing with our services any content (UGC) which may violate another party’s intellectual property rights, privacy, publicity, or other rights. If you believe any content on or transmitted through our platform or services violates or otherwise infringes upon your rights, you should make a written request for removal of such content from our platform and services to our Copyright Agent by:

Words of Veterans cannot help with previously published books delivered to users. Users are directly responsible for the content of their books (see UGC section of these Terms).

Disclaimers and Liability

1. OUR WEBSITES, PLATFORMS, SERVICES AND PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTY OF ANY KIND. WE EXPRESSLY DISCLAIM ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, ARISING FROM OR RELATING TO USE OF OUR WEBSITE, PLATFORM AND SERVICES, INCLUDING, WITHOUT LIMITATION, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.
   
2. WE DO NOT AND CANNOT WARRANT YOUR ACCESS TO AND USE OF THE WEBSITE WILL BE UNINTERRUPTED, TIMELY, SECURE, ERROR-FREE OR VIRUS-FREE, OR THE RESULTS FROM THE USE OF THE WEBSITES, PLATFORM, OR THE SERVICES OBTAINED WILL MEET YOUR EXPECTATIONS.
   
3. USE OF OUR WEBSITE IS AT YOUR SOLE RISK. YOU WILL BE SOLELY RESPONSIBLE FOR ANY DAMAGE TO YOUR COMPUTER SYSTEM OR LOSS OF DATA THAT RESULTS FROM ACCESSING OUR WEBSITE.
   
4. NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED FROM US WILL CREATE ANY WARRANTY NOT EXPRESSLY STATED IN THESE TERMS OF USE.

Without limiting any of the foregoing, the print-on-demand books offered on the websites may be covered by a product warranty, and the limitations and disclaimers set forth herein will not limit or restrict any such warranty to the extent it applies to your purchase. Limitation of Liability

Our total liability to you for damages is limited to the payments made by you, or a grant provider for your direct benefit, to us for the purchase of ChatGPT tokens or products.

In NO EVENT WILL WORDs OF VETERANS, ITs licensors, services providers, agents, OR OWNERS be liable for damages under any legal theory, arising out of or in connection with your use, or inability to use, the WebsiteS, any content on the Websites or THIRD PARTY SITES, including, WITHOUT LIMITATION any direct, indirect, special, incidental, consequential, or punitive damages

General Terms

1. Our failure to enforce any right or provision in these Terms will not constitute a waiver of such right or provision. All waivers must be in writing.
2. These Terms and our Privacy Policy are governed under the laws of the State of Virginia without regard to its conflicts of law provisions.
3. You agree that any legal action arising from or related to the Terms, the use or inability to use the websites, platform or services, or the products will be brought only in the state or federal courts serving Prince William County, Virginia, and you consent to the jurisdiction of such courts.
4. If any provision of these Terms is held by a court with jurisdiction to be invalid, illegal, or unenforceable, such provision will be modified by the court so as to best accomplish the objectives of the original provision to the fullest extent allowed by law.

Changes and Consent

We may occasionally update or modify these Terms. When a revision is made, we will change the “last updated” information at the beginning of these Terms. We encourage you to periodically review these Terms. Your continued use of websites and platforms constitutes your consent to changes and updates to these Terms of Use.
